Terms of Service
Last updated:
These terms are an agreement between you and E.N. Productions LLC, a California company based in Los Angeles (“we”, “us”), which runs ADA Audit at ada-audit.com and app.ada-audit.com (the “Service”). By running a check, creating an account, or sending us an inquiry, you agree to them. If you use the Service for a business, you confirm you can accept these terms on its behalf.
1. What the Service does
The free check runs automated accessibility rules based on WCAG 2.2 Level AA against one public web page you submit, and shows a summary of what the rules found. If you sign in and confirm you manage the site, we can check up to 9 pages of it. We send sign-in links and results by email.
Paid audits and fixes are not sold through the website yet. When they are, a quote or order will set out their scope and price, and those terms will apply to that work alongside these.
2. Permission to test a site
Before a check runs, you confirm that you own the site or are authorized by its owner to have it tested. Only submit sites you are allowed to test. Our checker reads pages with ordinary GET requests, identifies itself as ada-audit-bot, and does not log in, fill in forms, or buy anything.
We may refuse, limit or stop a check, for example to keep within usage limits, to protect a site, or when a request looks automated or abusive.
3. What the results mean
Automated rules can test only part of WCAG. Many requirements, such as whether a page works with a screen reader or whether content makes sense, need a person to review.
- A result is not a certification that a site conforms to WCAG or complies with the ADA or any other law.
- The automated check score is a reference figure. A score of 100 means our rules found no issues on the pages checked; it does not mean the site is accessible or legally safe.
- Results are not legal advice. We do not promise that using the Service will prevent a demand letter or lawsuit. For legal questions, talk to an attorney; we are glad to work with yours on the technical side.
4. Your account
You sign in with a link sent to your email. Keep access to that mailbox secure, because anyone who can read it can sign in. Tell us at contact@enprods.com if you think someone else has used your account.
5. Acceptable use
Do not:
- test a site you are not authorized to test;
- get around usage limits, bot checks or domain verification, or submit checks in bulk by script;
- interfere with the Service or try to access data that is not yours;
- use the Service or its results to mislead others, for example by presenting a result as a certification.
6. Ownership
You keep all rights in your site. We keep all rights in the Service. You may use your results for your own business and share them with the people who work on your site, such as your developers or attorney.
7. No warranty
The free check and the rest of the Service are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that results are complete or error-free.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the free Service is limited to US$100. Paid work is governed by the liability terms in its quote or order.
9. Your responsibility
If a claim is brought against us because you had a site tested without authorization, or because you broke section 5, you will cover our reasonable costs of that claim, including attorney’s fees.
10. Ending use
You can stop using the Service at any time and ask us to delete your account. We may suspend or end access if you break these terms or if we stop offering the Service. Sections 3 and 6 to 11 continue after that.
11. Changes, law and language
We may update these terms. The date at the top shows the current version, and we record which version you agreed to when you run a check. If a change is significant, we will say so on the site or by email before it applies to you.
California law governs these terms, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts in Los Angeles County, California.
These terms are written in English. A Japanese translation is provided for convenience; if the two differ, the English version applies.
